Terms of Use

These Terms of Use (“Terms”) govern your access to and use of PixFits (the “Service”), operated by the PixFits team (“PixFits”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

PixFits lets you generate and edit images, video, and other media using third-party artificial-intelligence models. You select a model, provide inputs (such as text prompts or images), and the Service submits your request to a third-party model provider and returns the generated result. Available models, features, pricing, and limits may change at any time without notice, and models may be added or removed at our discretion.

2. Eligibility and accounts

• You must be at least 18 years old to use the Service.
• You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account.
• One person per account. You may not share, sell, or transfer your account or credits.

3. Credits, subscriptions, and payments

• Generations are paid for with credits, obtained through subscription plans or one-time credit packs. Credits are a prepaid, limited license to use the Service. They are not money, have no cash value, are non-transferable, and cannot be exchanged or redeemed for cash.
• Credits may expire. Subscription credits expire according to the terms of your plan (for example, at the end of a billing period or when a subscription ends). Applicable expiry is shown at purchase or in your credits page.
• If a generation fails for technical reasons, the credits spent on it are automatically refunded as credits to your account. Credits spent on completed generations are not refundable, including when you are dissatisfied with the output.
• Subscriptions renew automatically until cancelled. You can cancel at any time from your credits page; cancellation takes effect at the end of the current billing period.
• Payments are processed by our payment partners, which acts as the merchant of record. Your purchase is also subject to their own terms, and monetary refunds.
• We may change prices, plans, and the credit cost of models at any time. Changes apply to future purchases and generations, not to credits you have already bought.

4. Your content

• Inputs. You retain all rights to the prompts, images, and other material you submit (“Inputs”). You represent and warrant that you own or have all necessary rights to your Inputs, and that your Inputs and your use of the resulting outputs do not violate any law or the rights of any person — including intellectual-property, privacy, and publicity rights. If you upload an image of a person other than yourself, you confirm that person has consented.
• Outputs. As between you and PixFits, and to the extent permitted by applicable law, we assign to you all our right, title, and interest in the media generated for you by the Service (“Outputs”). You are responsible for how you use them.
• License to us. You grant us a limited, non-exclusive license to host, store, reproduce, and process your Inputs and Outputs solely as needed to operate and provide the Service. We do not use your content for marketing without your permission, and we do not train AI models on your content.
• Nature of AI output. Outputs are produced by machine-learning models and may be inaccurate, unexpected, or similar to outputs generated for other users. We make no representation that Outputs are unique, factually correct, or free of third-party rights, and we do not guarantee that any particular Output is protectable by copyright or usable for any particular purpose. Obtaining professional advice before commercial use is your responsibility.

5. Acceptable use

You agree not to use the Service to create, upload, or distribute:

• content that is illegal in your jurisdiction or ours, or that facilitates illegal activity;
• child sexual abuse material or any sexualized depiction of minors — real or generated — in any form;
• non-consensual intimate imagery, or sexual content depicting an identifiable real person without their explicit consent;
• deceptive impersonations of real people, including deepfakes intended to mislead, defraud, defame, or harass;
• content that infringes the intellectual-property or other rights of any person or entity;
• disinformation, or content designed to deceive in connection with elections, public health, or financial markets;
• content that promotes violence, terrorism, or hatred.

You also agree not to:

• circumvent rate limits, credit metering, moderation, or other technical controls of the Service or its model providers;
• access the Service through automated means except via interfaces we officially provide, or resell access to the Service;
• reverse engineer the Service, or use it to build a competing dataset or model;
• abuse the referral program or create accounts fraudulently.

We may review content and use automated moderation, but we have no obligation to pre-screen it, and responsibility for content rests with the user who created it. We may remove content, refuse generations, and suspend or terminate accounts that we reasonably believe violate these Terms. Third-party model providers apply their own content policies, and generations they refuse are outside our control.

6. Termination

You may stop using the Service and request deletion of your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. If we terminate your account for a breach of these Terms, any remaining credits are forfeited without refund. If we discontinue the Service entirely or terminate your account without cause, we will make a commercially reasonable effort to refund the unused portion of recently purchased credits.

7. Intellectual property of the Service

The Service itself — including its software, design, and branding — is owned by PixFits or its licensors and is protected by intellectual-property laws. These Terms grant you no rights in the Service other than the limited right to use it as intended. If you believe content on the Service infringes your copyright, contact us at contact@pixfits.com with enough detail to identify the content and your claim, and we will review and, where appropriate, remove it.

8. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT WILL BE STORED INDEFINITELY. THE SERVICE DEPENDS ON THIRD-PARTY MODEL PROVIDERS AND INFRASTRUCTURE THAT WE DO NOT CONTROL.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXFITS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY OUTPUT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

10. Indemnification

You will indemnify and hold harmless PixFits and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from your Inputs, your use of Outputs, or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. For material changes we will give notice through the Service or by email before they take effect. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of the Service is established, without regard to conflict-of-laws rules, and disputes will be resolved in the courts of that jurisdiction — except where the consumer-protection law of your country of residence grants you mandatory rights or a mandatory forum, which remain unaffected.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and PixFits regarding the Service.
